Terms and Conditions

  1. FlexiPlans Program

    These Terms and Conditions (“T&C”) apply to our FlexiEasy Plan, Flexi Complete Plan and Flexi Pass (“FlexiPlan”) – whether through the conversion from COURTS’ Absolute 0% Programme or upon our customer voluntarily subscription and/or application – and shall be read conjunctively with our Chattel Agreement (“Agreement”). In the event of any discrepancies or inconsistencies between this T&C and the Agreement, then the Agreement shall prevail as far as the respective FlexiPlan is concerned. Unless otherwise defined herein, all terms used or mentioned herein shall have the same meaning as defined in the Agreement therein.

  2. Requirement
    1. By choosing our FlexiPlan, you agreed that you have read and understood these T&C, and you acknowledge that the FlexiPlan you request is subject to final approval by COURTS.
    2. You agree to purchase from us, and we agree to sell to you, Goods via the FlexiPlan offered by COURTS. You understand that you are obliged to provide us any information and/or documents as which may be deemed necessary by COURTS from time to time by our employee. Any failure or delay on your part to submit the requisite information and/or documents may result in delay and/or rejection of your application by COURTS.
    3. To apply for the FlexiPlan, you shall fulfil the following criteria accordingly:

      Flexi Easy Singapore Citizen/ Permanent Resident 18–67 years 6–24 months $150
      Flexi Complete 6–60 months
      Flexi Pass 6-15 months, or the remaining S/E Pass period

      In addition, the following charges shall be applicable to the FlexiPlan:

      Flexi Easy 15.99% per annum $85 or 2.5% of goods value, whichever higher 1 month instalment
      Flexi Complete 23.99% per annum
      Flexi Pass 33.99% per annum $165
    4. Upon approval of the FlexiPlan offered by COURTS, you are obliged to execute the Agreement with COURTS within Seven (7) days together with the upfront payment of the First Month FlexiPlan Instalment and Processing Fees payable by you as herein mentioned.
    5. Notwithstanding anything herein contained, you are obliged to pay for all Taxes and/or any Stamp Duty in relation to the Agreement or the FlexiPlan as which may be prescribed by law from time to time.
    6. You shall make the repayment of the FlexiPlan in full, including but not limited to the Term Charge, Processing Fees, Late Payment Charges, Collection Fees, Legal Fees and/or any other monies accrued on any amount under the FlexiPlan as far as this Agreement is concerned.
  3. Repayment
    1. You hereby unconditionally and irrevocably agree to pay the FlexiPlan Instalments to COURTS on the date as which may be stipulated in the Agreement, whether formally demanded or not, punctually as indicated therein or at such other times as may be notified or demanded by COURTS.
    2. Any and all payments made by you may be applied and appropriated by us in such manner and order and to such accounts as we may select or determine at our absolute discretion notwithstanding any specific appropriation by you or any party making such payment.
    3. You hereby authorise us to, at any time without further notice or liability, combine or consolidate any one or more accounts which you may have with us and set-off or transfer any monies standing to the credit of such accounts in or towards the full or partial discharge of the total amount payable as specified in the Agreement by you to us.
  4. Direct Debit/Standing Instruction
    1. You hereby authorise us to, at any time without further notice or liability, combine or consolidate any one or more accounts which you may have with us and set-off or transfer any monies standing to the credit of such accounts in or towards the full or partial discharge of the total amount payable as specified in the Agreement by you to us.
    2. You may make the repayment of your FlexiPlan Instalments according to such amount granted or instructed by COURTS whether via cash, schedule transfer and/or by way of direct debit or standing instruction.
    3. If you option for a direct debit or standing instruction on your monthly repayment of the FlexiPlan Instalment, then you shall immediately inform us if there is any new credit/debit card account is issued to you in addition to/as replacement of/in lieu of the specified credit/debit card account.
    4. You hereby authorise COURTS to debit (whether automatically or otherwise) each such new credit/debit card account with all payments required pursuant to the terms and conditions of the Agreement and credit the same to COURTS’ account.
  5. Possession, Ownership and Passing of Risk
    1. You hereby acknowledge and agree that the title and ownership of all Goods that you have purchased from COURTS via the FlexiPlan shall pass to you only if and when all instalments and other moneys payable by you to COURTS have been duly paid, and you has not exercised any of his/her termination rights including those under this Agreement or under applicable law, but until that time such goods shall remain the sole property of COURTS, notwithstanding that you are in possession of the Goods.
    2. You shall use the Goods at your own risk and shall hold COURTS harmless throughout the entire term of the Agreement against from any other claims, actions or proceedings on any losses, damages or injuries thereby incurred or suffered by you and/or any other third party, whether or not it is due to the negligent and/or omission on the part of COURTS or its employees, staffs, workers, contractors, agents, representative or any of its related and/or subsidiaries companies.
  6. Default
    1. If there is any Events of Default committed by you, then in any such event, all the monies remaining owing by you to COURTS shall immediately thereupon or at any time thereafter at COURTS’ option become due and payable upon demand.
    2. You agree that if you fail to pay any sum on its due date or on demand if it is payable on demand, COURTS or any of our authorised representatives or agents shall be entitled at any time to collect such monies from you at your home address(es), work address(es) or any other address(es) known to COURTS from time to time.
    3. Alternatively, COURTS may terminate this Agreement, and on such termination, you shall no longer be entitled to possession of the goods without our consent, and neither party shall have any rights against the other, subject to any of your pre-existing liabilities to COURTS.
    4. Additionally, you shall be liable to the arrears of instalments set forth as stipulated in the Agreement as accrued due up to the date of termination, the cost of all repairs required to be done to the goods to put them in condition consistent with the performance of your obligations under the term and condition of the Agreement, and damages (if any) for prior breach of these terms and conditions contained in the Agreement therein.
    5. COURTS reserves the right to seek all remedies and exercise all rights under the law and in equity for such Events of Default and breaches.
    6. Notwithstanding the above, in the event of default in payment on the due date of any payment due hereunder or part payment thereof, you shall become liable to pay COURTS late payment interest as stipulated in the Agreement. You understand that payment of the interest provided in the Agreement therein is payable both before as well as after judgment is given by any court or tribunal of competent jurisdiction and does not affect and in no way operates as a waiver of COURTS’ rights as stipulated on above.
  7. Personal Data Protection
    1. You hereby consent for COURTS and its employees or agents to use the information, particulars, or details provided by you to administer your account with us, process applications submitted by you, verify your identity, send you important notices (such as changes to these terms), request feedback from you and for administrative or other internal purposes such as auditing, research and data analysis to improve our services, customer communications and programs.
    2. Pursuant to the Personal Data Protection Act 2012, you hereby warrant and understand that it is your obligation to ensure that all the personal data you submitted to us is true, accurate, complete, and not misleading.
    3. You hereby confirm that you are authorised to disclose any personal data, particulars, or details provided by you to any third party (including, without limitation, suppliers, logistics partners, credit bureaus, insurers and financial institutions) for the purposes of procuring the provision of services by such third party (including, without limitation, delivery of goods, product insurance, credit assessment, debt collection), obtaining credit and/or providing security or factoring, selling of receivables or any similar type of transaction, in connection with the FlexiPlan.
    4. Without limitation to the above, you understand that COURTS may collect, use and retain, and disclose to third parties, your NRIC/FIN/Work Pass details where COURTS is required or authorised to do so under the law, or it is necessary in the circumstances to accurately establish or verify your identity to a high degree of fidelity.

    6. You hereby acknowledge and expressly consent that we may at our absolute discretion record all incoming or outgoing telephone conversations, and you hereby irrevocably agree to the use of such recordings and any transcripts thereof which we may produce for any purpose that we deem fit, including its use in any proceedings against you or any other party.
  8. Late Payment Charges & Collection Fees
    In the event of any default of payment by you, a late payment interest of 18% per annum or the maximum rate permitted by law will be imposed upon you, together with the collection fees, administration fees and any other charges, costs and expenses thereby incurred by COURTS and we reserve the rights and discretion to vary, adjust or amend the late payment interest rate, collection fees and/or administration fees from time to time for any reason whatsoever, whether arising from the change in the Client’s Risk Profile or otherwise.
  9. Warranties And Representations
    You shall warrant and represent that:
    1. you are buying the goods for your personal use;
    2. no Event of Default has occurred and no Event of Default will occur throughout the term of the Agreement;
    3. by entering into the Agreement and your performance of any obligations under it, you will not be in breach of any other agreement to which you are a party;
    4. any certificate or other document signed by you as to the amount due to you hereunder at the date of such certificate or other document shall be prima facie evidence that the amount so certified was in fact due from you at the date of such certificate and it shall be accepted by you as final and conclusive; and
    5. your warranties and representations set out above shall be deemed to be repeated throughout the terms and conditions of the Agreement;
  10. Undertaking
    You hereby undertake to us that you shall: -
    1. pay to COURTS upon demand any monies which you are required or deemed necessary to pay as a result of any failure by you to comply with any of your obligations under the terms and conditions of the Agreement and any other expenses (including, without limitation, collection agent and administrative fees) that we may incur in consequence or arising out of default by you, including any expenses, legal or otherwise, incurred by us in the exercise or attempted exercise of our rights consequent on default and including legal costs (on a full indemnity basis);
    2. settle all instalments and any amount payable as specified in the Agreement in full;
    3. immediately inform COURTS in writing of your intention to reside outside Singapore and/or any change in your particulars or other information which you have provided to COURTS (including but not limited to your address or contact numbers or your credit/debit card account details); and
    4. immediately provide to COURTS with any information and/or document which may require from you from time to time;
  11. Notice
    In addition to any other mode of service available, we may serve any communication or document in a court action or proceeding to be served by personal service or otherwise (including but not limited to a Writ of Summons, Statement of Claim, Statutory Demand under the Bankruptcy Act (Cap. 20), Bankruptcy Application, Notice of Adjourned Hearing of Bankruptcy Application) by post, delivery to, or leaving it at your last known address(es) in our records. Such manner of service shall be deemed to be effective personal service even if it is returned undelivered:
    1. if sent by hand, at the time of delivery or when left at the address;
    2. if sent by ordinary or certified prepaid post to the address within Singapore, the following business day after posting;
    3. if sent by registered post to the address in Singapore, 2 business days after posting; and
    4. if sent by ordinary, certified prepaid post or registered post to an address outside Singapore, 5 business days after posting.
  12. Waiver Benefits
    1. In the event of unforeseen situations, the following waiver benefits shall apply:

      • Cost of repair for items belonging to designated applicant at premises only
      Up to S$10,000 any one item or S$30,000 for all items Up to S$30,000 any one item or S$80,000 for all items

      • Death or Total Permanent Disability
      Up to S$30,000 Up to S$60,000
      Accidental Hospitalisation Benefit
      • 1 month instalment for each day of hospitalization (General Ward)
      • 2 months installments for ICU
      Maximum 2 instalments Maximum 4 instalments
      Involuntary Unemployment
      • Maximum $1,000 per month
      Up to 4 months indemnity period Up to 12 months indemnity period
      Death, Permanent Disability or Critical Illness
      • Death or Permanent Disability not due to Personal Accident
      • Critical illness under one of the 37 major illnesses
      N.A. Up to $30,000 (only for 36-month and above)
    2. The waiver shall not exceed the total remaining instalments due from applicant.
    3. The waiver of remaining instalments is subject to review by COURTS.
    4. COURTS reserves the right to amend the terms and conditions of the waiver benefits. The prevailing terms and conditions will apply.
  13. Exclusion Of Liability
    1. Subject to applicable law, we shall not be responsible or liable to you in any way for the quality, delivery and performance of the goods and/or services paid under the Agreement (including any goods or services sold, made available or introduced to you by us), and your liability to us under the terms and conditions of the Agreement to pay to us the total amount payable as specified in terms and conditions of the Agreement shall not in any way be affected by any breach, withholding of payment, or non-performance by us of our obligation to you of any dispute, counterclaim or right of set-off that you may have against us.
    2. In no event shall we be liable in contract or tort or otherwise for any indirect, incidental, special or consequential losses, damages or liabilities arising out of or in connection with the terms and conditions of the Agreement.
  14. Disclaimer
    Notwithstanding anything herein contained, COURTS hereby reserve the right and discretion to revert, change, vary and/or amend the T&C as herein stipulated, including without limitation provisions relating to the types or quantum of charges as which may be imposed by COURTS, from time to time without further notice to you. These terms and conditions are provided for our client ease of reference only. The Approved Applicant on our FlexiPlan Program shall subject always to COURTS’ Chattel Agreement and shall be deemed final, conclusive and binding between the Parties.
